Judge orders sex change for Massachusetts murder convict

BOSTON (AP) — A federal judge on Tuesday ordered state prison officials to provide a taxpayer-funded sex-reassignment surgery to a transgender inmate serving life in prison for murder.

U.S. District Judge Mark Wolf ruled in the case of Michelle Kosilek, who was born as a man but has received hormone treatments and lives as a woman in an all-male prison. Robert Kosilek was convicted of murder in the killing of his wife in 1990.

Wolf is believed to be the first federal judge to order prison officials to provide the surgery for a transgender inmate.

Kosilek first sued the Massachusetts Department of Correction 12 years ago. Two years later, Wolf ruled that Kosilek was entitled to treatment for gender-identity disorder, but stopped short of ordering surgery. Kosilek sued again in 2005, arguing that the surgery is a medical necessity.

In his ruling Tuesday, Wolf found that surgery is the "only adequate treatment" for Kosilek's "serious medical need."

"The court finds that there is no less intrusive means to correct the prolonged violation of Kosilek's Eighth Amendment right to adequate medical care," Wolf wrote in his 126-page ruling.

Prison officials have repeatedly cited security risks in the case, saying that allowing her to have the surgery would make her a target for sexual assaults by other inmates.

But Wolf found that the DOC's security concerns are "either pretextual or can be dealt with by the DOC." He said it is up to prison officials to decide how and where to house Kosilek after the surgery.

I'm not so sure, CA...this story (as presented by the article above) smacks of someone "using the system" for special treatment. How is the plaintiff's case a "medical necessity," for example? In prison?!? Is the plaintiff actually assuring themself a "better position" by being the only women there? We need more information. While I am not opposed to TG rights...this case seems to be a suspicious avenue for asserting them.

P.S. Full disclosure: in a previous incarnation (my mid-twenties), I was a lawyer. I know, I know. Don't hold it against me.

doesn't so much matter if this particular person, about whose motives you are assuming the worst. "Is the plaintiff actually assuring themself a "better position" by being the only women there?" IMHO, that's preposterous-if anything, they are putting themselves in dire jeopardy. What's encouraging is that this is precedent setting judgement, opens doors, etc.

And we will try to forgive your past incarnations sins, but that's really between you and the Goddess.

First off, thanks for the pardon from the Goddess, CA. Looms like even a lawyer can get a blessing and reprieve from the Allmighty She-Who-Must-Be-Obeyed.

Second, my point was not as preposterous as it may seem. Granted, being the only woman in the prison may be a very precarious position (and the story raises that issue)...but I was alluding to an earlier Texas criminal case wherein a woman (non-transgendered) was petitioning to be placed in a all-male penitentiary (and not the women's prison) to basically get some "better treatment"...i.e., being the only woman, she would have to have some additional "rights" (shower, bathroom, etc) that the male prisoners would not be allowed. I forget the exact reason why the plaintiff made this demand, but she actually won at the lower court level...and wa overturned on appeal. It was indeed strange case. And was actually debated in my Criminal Procedure class. BTW - the appeals judge assumed she was taking advantage of the system.

Third, as for me "assuming the worst" about Michelle, the subject of the current case...no, not really. I just need more information. The article, as presented, seems to cast a suspicious light on Michelle.

Again, I am not sure that this is the best case to set a precedent for transgendered rights...wish it had been a more straight-forward one (no pun intended) without the criminal element of murder involved!

But to Cynthia Anne: Thanks for the debate and conversation!

P.S. I guess, for a more affirming story of the transgendered journey, I am thinking of the Wachowski Brother(s)...yes, there was no precdent-establishing lawsuit involved...but somehow, for the TG community it's a better source of inspiration...(and maybe I'm just being too idealistic here).

Well, little Cynthia's Pagan Priestess act is tres rusty, and I'm afraid as a mere acolyte of Brigid the Triple aspected, I cannot grant blessings or pardons myself. But Brigid is a sweet gal, and I'm sure she loves you.

And , it was you who opened up the entire "Bring on the lawyer jokes!" bit. On a personal note, my experiences with lawyers, PD's , and those who represented my interests in class actions or dealing with the Social Security Administration, well, it's been all tits and wine and sugar cookies; nothing but nice things. So, I think they get as bad a rap as the French do, jokewise. ^_^

In my estimation, this example has less to do with the case at hand than it seems. It's true that it points out that a situation of advantage, real or imagined, may exist for a woman at a man's prison ( sounds stupid, but SOMEBODY thought otherwise), the woman in your example is just that, a woman.
She's not going through a major life altering, traumatic surgical procedure; she's just getting on a bus.
It seems, to me at least, that the girl in Miki's example would have to have more more motivation than an (entirely hypothetical) position of slight advantage.
Besides, we don't yet know if, once the surgery is completed, whether she will then be transferred (as would be proper) to a women's facility. It's just as likely that she will make this petition herself ( tho, true, we don't know)

No, it probably isn't the "best case", but consider:

Just a few years ago, Gavin Newsome, the then-mayor of San Francisco, decided to issue marriage licenses to gay couples in defiance of the current state law that forbid them. A move that gained a lot of media attention.

Now, I HATE HIS FUCKING GUTS myself, and I'm glad he's off in Sacramento and not our mayor anymore, since he dismantled our public assistance programs and set the entire aid to the poor and homeless effort, an intricate, public and private multi-agency network, back YEARS...

Furthermore, the aforementioned city marriages, were, IMHO, a self-serving, opportunistic gesture of political grandstanding, by a rich, priviledged shallow ambitious politician in a town where the gay vote is vital to public success. None of the marriages were recognized by the state.

Nevertheless, it generated a lot of buzz and attention, and if that helped Gavin Newsome more than it helped gay rights, it still helped, so, even seething with resentment as I am, I'm glad he did it.

That's a matter of perspective. Ya, Ya, good for Lana Wachowski and all that, but really, she's too remote to most of us to serve as more than an unreachable daydream example. She's one of those very rare transgenders whose Gender Dysphoria didn't sabotage or derail her professional and personal creative drives and goals.
Most of us suffer more deeply than that, and our condition affects our functionality on so many levels. The more typical TG girl is poor, struggling away at a secretarial job or working the streets to save up enough for surgery, barely able to afford hormones without a struggle, lonely, desperately unhappy, and the constant target of street violence and police harassment.

Lana earned her position and power and money, so I don't begrudge it to her at all. But with as much money as she needs and more for surgery, gender-reassignment AND cosmetic, private security, and*gasp* think of all the CLOTHES! ahhhh.....I may be petty and have a huge chip on my shoulder, but for me she inspires more envy than hope.

I'm not a murderer, but I have spent a fair amount of time in jail, so, I've got a lot more in common with Miki's girl than with Lana.
